Mountain Luge

Article 1 : Generalities

The present general terms and conditions of sale and use apply to all the access tickets allowing the use of the Mountain Luge managed by the operator and mentioned above.
The customer acknowledges having read and understood these general terms and conditions of sale and use when purchasing an access ticket from the operator and expressly declares that he/she accepts them without reservation and without prejudice to the usual means of recourse. It is the customer's responsibility to find out about the products and prices offered (displayed at the operator's points of sale) and to select the most advantageous for him/her.

Only the latest French version of the general conditions of sale and use of access tickets to the Mountain Luge version applicable on 22/01/19 is authentic.
The staff cannot be held responsible for the client's choices.

 

 

  1. INTELLECTUAL PROPERTY :

The client does not acquire any right of ownership or use and will not be able to use the names, signs, emblems, logos, trademarks, copyrights and other signs or other literary, artistic or industrial property rights of the operator.
 

Article 2 : TICKETS

The proposed tickets are passage tickets determined for the Mountain Luge, a duration, a category of person and are usable only on the Hautacamou within the partner structures for which they have been issued.

Each ticket is registered as an access title to the Mountain Luge.

The user must be in possession of his ticket for presentation to the staff at each ride.

All public sales prices are displayed at the sales points of the leisure park and can also be consulted on the website: www.hautacam.com

These prices are expressed in euros and include all taxes. Price guides are also available at these points of sale.

2.1 MEDIA :

2.1.1 Paper media

Paper tickets correspond to tickets for less than 5 descents as well as to all combined products with less than 5 descents per person. They are non-nominative and reusable. They are non-nominative and reusable. They are a medium on which an access ticket is recorded, purchased at the cash desk.

2.1.2 5, 10 or 20 run tickets

Plastic-coated paper supports (One Way type) correspond to access tickets equal to or greater than 5 descents. They are non-nominative and reusable. This is a medium on which a ticket is recorded, purchased at the ticket office.

2.1.3 Season passes

This is a card (Stripe type) that can be reloaded and reused several times as long as the card is not technically altered.

 

Article 3 : Conditions of issue, Validity of ACCESS passes

All tickets entitle the holder to free circulation on the Mountain Luge during their period of validity, subject to weather, snow or economic conditions, but without any priority whatsoever.

Access passes are non-consecutive and non nominative. They are valid for a period of one year from the date of purchase at the cash desk.

Season passes are subject to the presentation of a recent photograph, from the front, without sunglasses or headgear, with the first and last name of the holder. Each time they come to the Leisure Park, season pass holders must present themselves at the cashier's desk with their season pass and a piece of identification, where they will be given a bracelet allowing them unlimited access for the day.

The age of the client will be determined on the day the pass becomes valid and will be issued upon verification of the documents justifying the said advantage.

3.1 SPECIFIC CONDITIONS OF DISTANCE SELLING

Once the order for the season pass has been confirmed by the customer, the pass ordered cannot be refunded, taken back or exchanged. Likewise, no modification can be made to the order.

To receive the package at home, the customer will have to pay the postal charges of 5,00 € (five euros). Otherwise, he/she can pick it up free of charge at the resort's ticket office.

3.2 METHODS OF PAYMENT

All the deliveries of a ticket will give place to a payment of the corresponding tariff.

Payments are made in euros :

  • either by check drawn on a French bank account, made out to the operator,
  • or in cash,
  • or by credit card accepted by the operator,
  • or by vacation vouchers.

For any payment by bank check, the presentation of an identity document will be required.

3.3 PROOF OF SALE

At the customer's request, a receipt will be issued showing, for a single transaction, the number of products purchased, a summary detail of these products, as well as the category (adult, child, etc.) of the access ticket, the total price excluding tax of the transaction and the total amount of VAT, regardless of the medium used. The number of passes, the category of person and the expiration date will be indicated on the pass, except for deposit passes sold by the operator's partners.)

The pass and the proof of entitlement, if requested, must be kept by the customer, who must be able to present them to the operator in the event of an inspection and in support of any request (e.g.: rescue, loss or theft, complaints, etc.)

 

ARTICLE 4 : SPECIFIC clauses

4.1 fraud - absence of a TITLE or invalid title

All users are checked at the start of the Mountain Luge. They must have a valid pass (date, age category, etc.).

Any user presenting a non-conforming ticket will be denied access to the Mountain Luge.

4.2 Loss - Destruction - Theft

In case of loss or theft of the pass, the found passes will be centralized at the main ticket office of Hautacam.

Any non-nominative pass that is not found will not be replaced or reimbursed, regardless of the evidence produced, because the identification of the pass cannot be done.

For season passes, the holder must declare the loss at the operator's ticket office, with proof of purchase, in order to receive a replacement pass for the remaining period.

To obtain a duplicate of a lost season pass, the user must pay a processing fee of €5.00 (including VAT).

4.3 PARTIALLY USED OR UNUSED PASSES

In the event that the issued passes are not used or are completely exhausted, they will not be refunded or exchanged due to their one-year validity.

4.4 ILLNESS OR ACCIDENT

No refunds will be made for accidents, illnesses or any other personal reasons, regardless of how long the pass is valid.

4.5 STOP OF THE MOUNTAIN SLED / WEATHER CONDITIONS

Only a complete stop of more than one hour of the Mountain Luge activity and related activities of the Hautacam Leisure Park (Cardouet ski lift and mini quads) can give rise to a compensation of the damage in proportion to the consumption already used (with the exception of season passes). The customer must, to benefit from this, present himself at the ticket office of the Hautacam Leisure Park with his ticket(s) issued at the time of purchase.

The user will not be entitled to any sum or service exceeding this fixed compensation.

The operator cannot be held responsible for the weather conditions encountered when using the ticket.

It is the responsibility of each customer to find out about the weather conditions and visibility by all means at his disposal. (Internet sites and Social Networks and Applications Meteo France, Meteo Blue, Meteo Sky, etc. ...)

4.6 MATERIAL OR PHYSICAL INJURY ON THE MOUNTAIN SLED

In case of material or physical damage caused by the Hautacam Mountain Luge, the user must immediately report the damage to the staff of the luge and fill out an accident report.

4.7 COMPLAINTS

Any claim must be addressed to the operator within 4 (four) months of the occurrence of the event giving rise to the said claim, without prejudice to the legal means and time limits for taking legal action, at the following address

ARTICLE 5 : RESPECT FOR SAFETY RULES

All holders of a pass giving access to the Mountain Luge are required to respect the safety rules, in particular the police regulations and the pictograms at the start of the Mountain Luge, as well as any instructions given by the operator's staff, under penalty of punishment.

The user is solely responsible if the instructions are not respected.

 

ARTICLE 6 : PROTECTION OF PERSONAL DATA

All the information requested by the STEM HAUTACAM operator for the delivery of a season pass is mandatory. If one or more mandatory information is missing, the issuance of the pass could not take place.

These data are collected for management purposes, control of access tickets and statistics.

All of this data is only intended for STEM HAUTACAM. In accordance with the Data Protection Act of January 6, 1978, amended by the Act of August 6, 2004 No. 78-14, the holder has a right of access, rectification and opposition for legitimate reasons to the company by writing to the following address

Purpose of the processing: Ticketing, access control, management of customer and prospect files.

In application of the article 90 of the decree n°2007-451 of the 25/03/2007, any person can receive the information of the present paragraph on a written support, after a simple oral or written request to the above mentioned service.

Use of ski lift tickets

Article 1 : Generalities

The present general terms and conditions of sale and use apply to all lift tickets giving access to the ski area managed by the operator and mentioned above.
If any provision of the present terms and conditions is missing, it will be considered as being governed by the practices in force in the ski lift industry and for companies with their head office in France.
The customer acknowledges that he/she has read the present general terms and conditions of sale and use when purchasing a ticket from the operator and expressly declares that he/she accepts them without reservation and without prejudice to the usual means of redress. It is the customer's responsibility to find out about the products and fares offered (displayed at the operator's points of sale) and to select the most advantageous ones for him/her.
 

Only the latest French version of the general conditions of sale and use of ski lift tickets applicable on 22/01/2019 is valid.

The staff cannot be held responsible for the customer's choices.

Article 2 : TITLES

The tickets offered are ski passes (hereinafter referred to as "pass") determined for a validated area, a duration, a category of person and are usable only on the network of ski lifts of the ski area(s) for which they were issued.

The pass is composed of a "hands-free" type pass on which is recorded a transport title.

The user must carry the pass throughout the entire trip on the lift, from the departure area to the arrival area.

All the public rates for the sale of ski passes are displayed at the sales points of the ski area concerned and can also be consulted on the website: www.hautacam.com

These prices are expressed in euros and include all taxes. Price guides are also available at these points of sale.

The " lift passes " offered can be sold with an insurance covering the rescue on the slopes. This insurance is personal and cannot be transferred or refunded. It is the client's responsibility to choose whether or not to take out this insurance (expressed per day and per person) before using the pass.

2.1 MEDIA :

2.1.1 Single-use media

The plastic-coated paper supports (One Way type) or cards are for single use only and cannot be reused (except for the 2-day passes which can be used the day of purchase and the following day). This is a medium on which a ticket is recorded, purchased at the cash desk.

2.1.2 Season or 3, 4 and 6-day consecutive or non-consecutive passes

This is a card (Stripe type) that can be reloaded and reused several times as long as the card is not technically altered, on which a ticket purchased at the cash desk is recorded.

Article 3 : Conditions of issue, Validity of transport tickets

All passes give the right, during their period of validity, to free circulation on the ski lifts of the ski area for which they have been issued, subject to weather, snow or economic conditions, but without any priority of any kind whatsoever.

Ski passes with a duration of 1 (one) day or more are strictly personal, non-transferable and non-transferable, with the exception of "4 (four) day, 2 areas, non-consecutive or consecutive" ski passes.

Season passes are subject to the submission of a recent photograph, from the front, without sunglasses or headgear, with the first and last name of the holder.

Discounts or free passes are offered to different categories of people according to the terms and conditions available at the points of sale and upon presentation of documents justifying the said benefit at the time of purchase or at any eventual check.

No claim or refund will be granted after the purchase.

The age of the customer to be taken into account will be that on the day of the beginning of the validity of the package to be delivered on control of documents justifying the said advantage.

3.1 SPECIFIC CONDITIONS OF DISTANCE SELLING

Once the order of the package is confirmed by the customer, the package ordered cannot be refunded, taken back or exchanged. Likewise, no changes can be made to the order.

To receive the package at home, the customer will have to pay the postal charges up to 5,00 € TTC (five euros TTC). Otherwise, he/she can pick it up free of charge at the resort's ticket office.

3.2 METHODS OF PAYMENT

3.3 SALES RECEIPTS

 

For each sale, a receipt will be issued showing, for a single transaction, the number of products purchased, a summary detail of these products, as well as the category (adult, child, etc.) of the ticket, its expiration date, its media number, any insurance taken out, the total price excluding tax of the transaction and the total amount of VAT, regardless of the media used.

This document must be kept by the customer, who must be able to present it to the operator in the event of an inspection and in support of any request (e.g.: rescue, loss or theft, complaints, etc.)

 

ARTICLE 4 : SPECIFIC transport clauses

4.1 fraud - absence of a pass or invalid pass

Any user is likely to be controlled at the departure or arrival of the ski lifts. They must have a valid ticket (date, ski area, age category, etc.).

The user presenting a non-conforming ticket will be denied access to the ski lifts and will be redirected to a sales point in order to regularize his situation.

Any user using a ski lift giving access to the ski area covered by these conditions, without a pass or with an invalid pass, will be subject to the proceedings and/or compensation defined below:

  • Payment of a lump sum indemnity equal to FIVE times the value of the daily pass corresponding to the ski lift network in question (Articles L342-15, R 342-19 and R 342-20 of the Tourism Code).
  • Legal proceedings.
  • In addition to the above-mentioned fixed compensation or legal proceedings, the operator's sworn agents will immediately withdraw any personalized lift pass (name, photograph, specific rate reduction, etc.) that does not correspond to the holder, in order to return it to the holder and/or compile an infraction file.
  • In case of refusal, a complaint for fraud will be filed with the gendarmerie and criminal proceedings will be initiated.
  • Depending on the seriousness of the offence committed, this may give rise to the payment of a fixed indemnity plus any file costs, or to legal proceedings, as well as the payment of damages.

4.2 Loss - Destruction - Theft

In the event of loss or theft of the ticket, the tickets found will be centralized at the main ticket offices of the ski area.

Any daily or 2 (two) day ticket not found, regardless of the evidence produced, cannot be replaced or reimbursed, as the identification of the ticket cannot be done.

For any longer period, the holder must declare it to the operator's ticket office, with proof of purchase, in order to benefit from a replacement ticket for the remaining period minus a half-day's deductible, which will be billed to the customer according to the current fare.

4.2.1 Misuse

It is reminded that ALL TICKETS, including those corresponding to the shortest duration of the fare schedule (4 (four) hours), are strictly personal, non-transferable and non-transferable. It is therefore the user's responsibility to keep his or her ticket in such a way that it cannot be misused by a third party.

4.2.2 Processing fees

In order to obtain a duplicate of a lost season ticket, the user must pay a processing fee of €5.00 (including VAT). The user whose pass has been returned by the Hautacam ski resort must contact the latter.

4.3 PARTIAL OR UNUSED SKI PASSES

In the event that the tickets issued are not used or are completely sold out, they will not be refunded or exchanged.

4.4 ILLNESS OR ACCIDENT

No refunds will be made for accident, illness or any other personal cause, regardless of the validity of the pass.

An insurance service can cover this risk, useful information can be obtained from our sales hostesses.

4.5 SKI LIFT SHUTDOWN / WEATHER HAZARDS

Only a complete stoppage of more than half a day (or 4 consecutive hours) of all the ski lifts can give rise to compensation for the damage (except for season passes). In order to benefit from this compensation, the customer must present his or her ticket and hand in the complaint form available at the operator's sales points.

The holder of a pass (except for season passes) may receive compensation after presenting supporting documents in the form of

  • immediate extension of the validity of the pass,
  • a credit note to be used for the current season, or for the season following the current season.

The user will not be entitled to any sum or service in excess of this fixed compensation.

The operator cannot be held responsible for the weather conditions encountered when using the pass.

It is the responsibility of each customer to find out about the weather conditions and visibility by all means at his disposal.

4.6 MATERIAL OR PHYSICAL DAMAGE ON A LIFT

In the event of material or physical damage caused by one of the ski lifts in the ski area concerned, the user must immediately report the damage to the lift personnel and fill out an accident report.

4.7 COMPLAINTS

Any complaint must be addressed to the operator within 4 (four) months of the occurrence of the event giving rise to the complaint, without prejudice to the legal channels and time limits for taking legal action, at the following address

ARTICLE 5 : DEFECT OF THE SUPPORTS OF THE TITLES

In case of malfunction or technical failure of a ticket holder during its period of validity, the operator will proceed, at its own expense, to the replacement of the holder against and from the restitution of the latter in one of the operator's sales outlets.

However, if after verification, the defective media is attributable to the user, the operator will invoice the user for the cost of replacing the defective media on the basis of the tariff in force.

The user holder of a ticket issued by the Gavarnie-Gèdre ski resort will be given exceptionally a day ticket by the Hautacam ski resort after verification of the sale with the Gavarnie-Gèdre ski resort. However, in order to obtain the replacement of his support, the user will have to address his request directly to this last one; his request will not be able to be treated by the operator of the ski resort of Hautacam.

 

ARTICLE 6 : RESPECT FOR SAFETY RULES

Any holder of a ski pass giving access to the ski lifts is required to respect the safety rules relating to transport by ski lifts, in particular the police regulations and municipal decrees posted at the departure point of the ski lifts, the pictograms completing them as well as any instructions given by the operator's personnel, under penalty of sanction. Likewise, on the ski slopes, the user of the ski area is subject to the respect of the prefectural decree relating to safety on the ski slopes and is recommended to take into account the "rules of conduct for users of the slopes" published by the International Ski Federation (FIS).

Off-piste skiing is practiced by the user at his/her own risk.
 

ARTICLE 7 : PROTECTION OF PERSONAL DATA

All information requested by the STEM HAUTACAM operator for the delivery of a ski pass is mandatory. If one or more mandatory information is missing, the package cannot be issued.

These data are collected for management, ticket control and statistical purposes.

Personalized tickets are also collected for the purpose of managing access to the ski lifts and checking tickets. This data is also collected for statistical purposes. Anonymous passes are also offered for sale, except for the 3 (three) day, 6 (six) day and season passes.

All of this data is only intended for the STEM HAUTACAM company.
